No Win, No Fee

We act on behalf of our clients on a no win, no fee basis ( also known as a conditional fee arrangement). This allows a claim for compensation to be pursued without any financial risk and without paying any legal fees upfront. If the claim is successful you make a contribution from your compensation to pay your legal costs but that deduction is subject to a maximum of 25%. If the claim is unsuccessful you won’t have to pay any legal fees- either to this firm or your opponents.

Time Limit For Making A Personal Injury Claim

The standard time limit for making a personal injury claim is three years. The three year period begins on:

  • The date of incident that caused the injury or illness
  • The date you became aware of a condition or illness
  • The date you became aware of the death of a loved one or family member

The exceptions to the standard time limit are as follows :

  • Children - for an injury sustained before a person's 18th birthday a claim can be made up the injured person’s 21st birthday
  • Those who lack mental capacity - no time limit
  • Accidents abroad - the time limit for the country where the accident happened may be shorter
  • Criminal Injury - Claims made to the Criminal Injury Compensation Authority (CICA) must be submitted within 2 years of the incident
  • Claims for injuries caused by a defective product must be made within 10 years of the product going into circulation

How Much Compensation Will I Get?

A compensation claim is formed of two different parts, General Damages and Special Damages.

General Damages

This element of the claim is to compensate you for the injury itself and the pain, suffering and restriction caused by it. This is valued by reference to independent medical evidence secured by your lawyer.

Special Damages

This element of the claim is for any financial loss or expense suffered as a direct consequence of the accident and includes things like loss of earnings, medical treatment costs and care. Your lawyer will advise you on the evidence required to prove each element of the claim.
